N.F.Railway, Construction Organisation invites application from intending contractors for Registration for Civil Engineering works under the following class:

                    (i) Class –‘A’ – More than Rs. 1.00 Crore
And up to Rs.5.00 Crores.
(ii) Class –‘B’ – More than Rs. 25.00 lakhs
And up to Rs.1.00 Crore.
(iii) Class –‘C’ – Up to Rs.25.00 Lakhs.

1(a)      Eligibility Criteria for     Class-  A Category        :

(i)                  They should have an engineering organization with at least a graduate Engineer having a minimum of 10 years experience plus an Engineering diploma holder having a minimum of 5 years experience in relevant discipline and should maintain a minimum compliment of transport equipments and construction tools and plants commensurate with the nature of works being done by them.

(ii)                At the time of enlistment, they should have satisfactorily executed at least two Civil Engineering works, each individually costing not less than Rs.1.00 Crore.

(iii)               During the last 3 financial years, they should have received contractual payments of at least Rs.5.00 crores.

1(b)      Eligibility Criteria for     Class-  B Category :

(i)                  They should have an engineering organization with an Engineering diploma holder having a minimum of 5 years experience in relevant

(ii)                At the time of enlistment, they should have satisfactorily executed at least two Civil Engineering works, each individually costing not less than Rs.25.00 Lakhs.

(iii)               During the last 3 financial years, they should have received contractual payments of at least Rs.1.00 crores.

1(c)      Eligibility Criteria for     Class-  C Category  :

(i)                  They should have an engineering organization with an Engineering diploma holder having a minimum of 3 years experience in relevant

(ii)                At the time of enlistment, they should have satisfactorily executed at least two Civil Engineering works, each individually costing not less than Rs.10.00 Lakhs.

(iii)               During the last 3 financial years, they should have received contractual payments of at least Rs.25.00 Lakhs.

2)         The contractor desirous to being registered with this organization should submit their applications in the prescribed proforma furnishing full credentials and other required information. An application for registration received in any other form (Other than Railway’s format) will be summarily rejected and will not be considered for registration.

3)         Prescribed Registration form (not transferable) can be obtained from the office of the General Manager/Con, N.F.Railway, Maligaon, Guwahati -781011, during office hours with effect from          26.10.2009 and up to 16.00 hours of 10.11.2009 on payment/ submission of Rs10,000/- in the form of Crossed Demand Draft drawn in favour of Financial Adviser & Chief Accounts Officer/Con, N.F.Railway, Maligaon. Outstation firms requiring Registration document by post shall remit the sum as specified above plus Rs.500/- extra per set as postal charges to reach the office of the General Manager/Con, N.F.Railway, Maligaon, Guwahati -781011 latest by 26.10.2009. Railway will not be responsible for any delay, damage or loss of documents in transit.

3(a)      The Registration documents will also be available in Northeast Frontier Railway construction website in www.nfrly construction.org during the above mentioned period and same can be down loaded and used as Registration documents for submitting the request for registration. However, the Demand Draft for Rs. 10000/- to the cost of Registration documents as mentioned above will have to be enclosed while submitting the Registration documents.  Otherwise, the Registration will be summarily rejected.

4)         The registration documents complete in all respects will be received with effect from       26.10.2009 and up to 14.30 hours of  13.11.2009 by the office of General Manager/Con, N.F.Railway, Maligaon, Guwahati -781011 for which one box will be kept in the office of the General Manager/Con, N.F.Railway, Maligaon, Guwahati -781011. If the last date of issue/ receiving happens to be Bundh/Holiday(s), the Registration documents will be issued/ received on the following working day as per same timings. The Box will be opened on 13.11.2009 at 15-30 Hrs.

5)         The Railway reserves the right to reject the request of any one of the applicant request for registration of his/ their name(s) as an approved contractor without given any reason whatsoever.

6)         The facility of Standing Earnest Money has been done away with Registered contractors in respective category should submit Earnest Money with each and every tender as per tender condition.

7)         It is understood and agreed by the applicant contractor that submission of the application for registration does not confer on him/them any right in regard to award of contracts, except for being considered for enlistment in approved lists and entitled to submit his/ their bids as and when specifically called upon to do so.

8)         For registration in the approved list in ‘A’ class, ‘B’ class and ‘C’ class the contractor should furnish a non-refundable fee of Rs.30,000.00 (Rupees thirty thousand only), Rs.20,000.00 (Rupees twenty thousand only) and Rs.15,000.00 (Rupees fifteen thousand only) respectively in the name of Financial Adviser & Chief Accounts officer/ Construction, N.F.Railway, Maligaon.

9)                  An annual fee of Rs.2,000/- (non –refundable) shall be deposited by each registered contractor(s) to cover the cost of sending notices to them and clerkage for tender etc. in the name of Financial Adviser & Chief Accounts officer/Construction, N.F.Railway, Maligaon before 31^st March of every year.

10)       The approved lists of contractor are only for the official use of Railway. The approved lists of contractor shall, therefore, be treated as confidential record of Railway and will not be supplied to the contractors in any case.

INFORMATION & INSTRUCTIONS FOR REGISTRATION

PAPRT-I

1.0       INFORMATION

1.1       The Northeast Frontier Railway Construction Organisation (as distinct and separate from the Open Line Organisation), hereinafter referred to as N.F.Railway (Construction), has invited applications from Civil Engineering Contractors for Registration of their names in the approved list of contractors with the N.F.Railway (Construction). On receipt of the applications for registration in the prescribed forms, the N.F.Railway(Construction), will at their discretion, enlist contractors considered suitable for Railway’s works in the approved lists of Contractors.

1.2       Registration of the intending contractors shall be done separately for different categories of works in the Civil Engineering Department and in different Area of works.

1.3       The N.F.Railway (Construction) intends to use, at its sole discretion, the aforementioned Approved Lists of Contractors for inviting limited tenders from the contractors borne on such approved lists as & when the N.F.Railway(Construction) finds it expedient to invite limited tendersfor Civil Engineering works. The information of such approved lists of contractors or the above stated intention of the N.F.Railway(Construction) to invite limited tenders shall not, however, be construed as being a constraint for Civil Engineering works adopting any of the methods current on the N.F.Railway(Construction) from time to time.

2.0       REGISTRATION PARTICULARS:

2.1       The aforementioned approved lists of contractors shall be formed separately for the following categories of works and area of works. The decision of N.F.Railway(Construction) regarding the classifications in any of the categories is final and conclusive -

(A)       CATEGORIES OF WORKS:

The  aforementioned  approved  lists  of  contractors  shall  be  formed   for the  following  categories  of  works  and  area  of  works,  the decision  of  the  N.F.Railway/Con regarding the classifications in any of  the  categories is  final and conclusive.

(I)                 Building/Miscellaneous Structure Works  :  These  shall  cover  all  types  of  Civil  Engineering  works connected  with  construction  and  repair  works  of  building etc. excluding the type of works as detailed hereinafter.

(II)               Earthwork: These shall cover earthwork in formation/cutting for construction of new railway line/Gauge Conversion/Doubling including earth work for development of stacking area, circulating area , protection work etc.

(III)           Bridge Works: These shall cover construction of all types of bridges excluding Structural  Steel  Works for Super-structure of steel girder bridges..

(IV)         Structural  Steel  Works  :  These  shall  cover  fabrication  and  erection  of  all  types  of structural steel works including fabrication and erection of the steel bridge girders etc.

(V)           Supply  of  Material  :  These  shall  cover  supply  of  all types of Building materials including Quarry products like  track  ballast , quarry dust, un-screened shingles, boulder etc. procured  by  the  Civil  Engineering  Department  from time  to time.

(VI)         Permanent Way Works : These shall cover all types of works connected with Permanent Way involving linking, packing & deep screening  etc.as assigned to contracting agencies from time to time.

(VII)  Transportation of Materials: These shall cover transportation of materials including  P-Way materials i.e. PSC Sleepers,  Rails etc.

(VIII) Surveys:  These shall include survey works including Final location  survey and   Geo-technical investigation

2.3             Certificates in respect of Engineering organization – engagement of Engineers, possession of plants and machineries, vehicles etc. signed by the applicant and duly certified by the Executive Engineer or above under whom they worked and in respect of completion of works satisfactorily, mentioning the date of commencement and completion, duly signed by the Executive Engineers under whom the works have been executed, should form a part of the enclosures of the registration documents. Technical Consultant/ Consulting Engineers will not be considered as a part of Engineering organization.

2.4              Engagement of retired Engineers (Gazetted) of Govt. departments who are eligible for engagement as per extant rules will also form a part of the Engineering organization equivalent to B.E. Degree holders, provided documents in their proof are submitted along with consent letter.

2.5              The Contractor applying for Registration can, through a single application, request for being considered in one or more or all categories of works consistent with his credentials and past experience of execution of works under different categories.

2.6              The approved lists of contractors as formed by N.F.Railway (Construction) at the appropriate levels shall be periodically reviewed by the authorities nominated in this behalf. Based on such reviews conducted by N.F.Railway (Construction), without assigning any reason whatsoever, the enlisted contractors can be deleted from the class in which they have been enlisted.

2.7              Once the Contractor is borne on the approved list, it wll remain valied for 3(three) years, unless already deleted during the Annual Review or the expiry of the validity of the “Approved List” as a whole, whichever is earlier.

2.8              In case the de-listed contractor wishes to be on registration, he should apply afresh after securing and completing the work in the Railway by open competition along with fulfilling all the conditions stipulated for enlistment.

2.9              At any time as determined by a contractor, he can request the appropriate office of the N.F.Railway(Construction) in writing to exclude his name from consideration for Registration/ Deletion of his name from the approved lists in one or more of work categories. On receipt of such an application, the N.F.Railway (Construction) will take appropriate action in regard to exclusion/ removal of the applicant contractor’s name from the Approved Lists. If the contractor, thereafter again desires to be considered for inclusion in the Approved Lists, excluding these on which his name is continued to be borne, a fresh application for registration complete in all respects shall have to be submitted by the contractor when notice is issued which will be dealt with as a new case of application for registration without any reference to the earlier registration since cancelled.

3.0              The approved lists of contractors are only for the official use of the N.F.Railway(Con). The approved lists shall, therefore, be treated as a CONFIDENTIAL record of the N.F.Railway(Con). The status of the contractors in regard to their enlistment and work categorization from time to time will be revealed to them through the notices inviting Limited Tenders. Inclusion/ non-inclusion of the contractors in the approved lists, however, does not bar them in any manner whatsoever from submitting tenders for any category of work or value of tender, when Open Tenders are invited by the N.F.Railway(Construction).

3.1       The enlistment of the contractor for any category of work shall be as decided by the N.F.Railway (Construction) at its sole discretion, adopting any procedure as considered appropriate from time to time.

4.0              STANDING EARNEST MONEY REGISTRATION FEES & CLERICAL CHARGES:

4.1       The facility of Standing Earnest Money has been done away with.

5.0              ISSUE OF REGISTRATION DOCUMENT :

5.1   Prescribed forms along with instructions will be available in the office of The General Manager/Construction, N.F.Railway, Maligaon, Guwahati -781 011. on any working day from 04.11.2009 to 16.00 hrs. of 11.11.2009  on payment of Rs.10,000/- (Rupees ten thousand) only for Class-A, Rs.5,000/- (Rupees five thousand) only for Class-B and Rs.3,000/- (Rupees three thousand) only for Class-C in cash or in the shape of Demand Draft (Rs.500/- to be paid extra for each if required by post ) in favour of FA&CAO/Construction, N.F.Railway, Maligaon, Guwahati -781 011, Assam.

5.2              Payment for the registration documents will be accepted only in cash or  in the shape of Demand Draft in favour of FA&CAO/Construction, N.F.Railway, Maligaon, Guwahati -781 011, Assam. Remittance in form other than the above should not be accepted and for such remittance the registration documents shall not be issued to the applicants.

5.3             Issuing and Receiving of prescribed forms of registration will be dealt by the office of the General Manager/Construction, N.F.Railway, Maligaon.

5.4             Outstation firm may remit Rs10,500/- , Rs.5500/- &  Rs.3500/-only for Class-A, Class-B & Class-C respectively by Demand Draft in favour of FA&CAO/Construction, N.F.Railway, Maligaon, Guwahati -781 011, being the cost of each set of papers including postal charges. Request for enlistment document in Company’s letter head duly stamped, along with cost of documents should be submitted for issuing Enlistment Form from the office of the General Manager/Construction, N.F.Railway, Maligaon, Guwahati -781 011.

5.5             The enlistment documents will also be made available in Northeast Frontier Railway’swebsite i.e.www.nfrlyconstruction.org during the above mentioned period and the same can be down loaded and used for enlistment. However, a Demand Draft of Rs10,000/- (Rupees ten thousand) only in favour of FA&CAO/Construction, N.F.Railway, Maligaon towards the cost of enlistment documents will have to be enclosed along with the enlistment document while submitting the same. In case, the Registration Form is not accompanied with valid demand draft drawn in favour of FA&CAO/Construction, N.F.Railway, Maligaon, Guwahati-781011 for the cost of the documents, the enlistment

form will be summarily rejected.

5.6             Railway Administration will not be responsible for any delay/ difficulty/ inaccessibility/ of the down loading facility for any reason whatsoever. In case of any discrepancy between the registration documents downloaded from internet and the master copy available in the office, the later shall prevail & will be binding on the intending contractor/s. No claim on this account will be entertained.

6.         MODE OF DELIVERY OF REGISTRATION DOCUMENTS

6.1    The registration documents complete in all respects will be received with effect from       04.11.2009 and up to 14.30 hours of  11.12.2009 by the office of The General Manager/Con, N.F.Railway, Maligaon, Guwahati -781011 for which one box will be kept in the office of the General Manager/Con, N.F.Railway, Maligaon, Guwahati -781011. If the last date of issue/ receiving happens to be Bundh/Holiday(s), the Registration documents will be issued/ received on the following working day as per same timings. The Box will be opened on 15.12.2009 at 15-30 Hrs. Railway administration shall not be responsible for any kind of delay in receiving the registration documents by the applicant or missing during postal communication.

6.2    Request for issuing registration documents in prescribed forms shall be made in the letter pad or in plain paper duly stamped to the issuing offieces as detailed in Para 5.1 above on any working day from 10.00 hrs. to 16.00 hrs.from.

7.0    DATE & TIME OF SUBMISSION OF REGISTRATION DOCUMENTS:

7.1    The registration documents complete in all respects should be submitted on or before 11.12.2009 by the intending contractors on any working day to the General Manager/ Construction’s office (up to 14.30 hrs.) .

7.2    All copies of Annexure to the registration documents must be self-signed/ attested by a Gazetted officer.

8.0        ADDITIONAL INFORMATION:

For any additional information/ clarification on the matters relating to registration of contractors, the concerned office issuing the registration documents may be contacted on any working day between the office ours (i.e. 09.30 to 16.30 hrs)

9.0        INSTRUCTION:

9.1    The contractor requesting for registration is advised to study the Registration Documents carefully.

9.2              It is desirable that the intending contractor must obtain for himself on his own responsibility and his own expense all information which may be necessary for the purpose of applying for Registration.

93.       Any clarification required shall be obtained from the office from where the registration document has been purchased by the contractors. The clarification can be obtained during the working hours on any working day.

9.4       The application for registration shall be submitted, adopting the form given in this Registration Document. An application for registration received in any other form may, at the sole discretion of the General Manager/Construction, N.F.Railway, Maligaon be rejected and therefore not considered for registration.

9.5              The application for registration shall be complete in all respects covering PART-II(a) and II(b) of the Registration Document and enclosing the requisite information about the applicant contractor in the form of Annexure. Although not bound under the conditions for registration, the applicant contractor can conveniently adopt the various forms of Annexure enclosed in the Registration Document (Annexures ‘A’ to ‘F’)

9.6              Submission of complete and accurate information is the responsibility of the contractor applying for registration. The N.F.Railway(Construction) reserves the right to verify, in any manner, at its sole discretion, the accuracy of the information furnished by the contractor applying for registration. If it is revealed, whether before or after the forming of the approved lists, that a contractor had knowingly submitted incorrect information (including suppression of information relevant to the registration process) to get himself registered with the N.F.Railway (Construction), apart from the excluding/ deleting the defaulting applicant contractor’s name from the approved list, the N.F.Railway and the other organization under the Indian Railways will be entitled to suspend business with the defaulting applicant contractor, without giving any show cause or any other Notice in this behalf.

9.7              Every contractor applying for registration shall state in his application his postal address fully and clearly including Pin Code for communication/ correspondences. Any communication sent to the contractor by post at the said address shall be deemed to have reached the contractor.

9.8              All pages of the application for registration and all the Annexure therewith shall be signed by the individual or individuals legally authorized to sign on behalf of the contractors.

9.9              Certificates from the department concerned under whom the works have been completed/ are in progress as referred to in Annexure-B should be enclosed. In case the applicant is a firm, the certificates of credentials, financial certificates shall be in the name of the firms and not in the name of individual of the partnership. Certificate issued by the Govt. department and PSUs shall only be accepted. Certificate of private individuals shall not be accepted.

9.10  Information/ particulars in respect of works executed satisfactorily vide Annexure-‘B’ should be of those works which were completed/are in progress during the last 3(Three) years from the date of submission of the application for registration (i.e from April/2006 to March/2009)

9.10          Copies of the testimonials of Graduation and Diploma and consent letters signed with date in support of working with the applicant Contractor/ Firm from the Graduate Engineer and the Diploma Holder, duly attested by a Gazetted officer should be enclosed which would form a part of the registration document.

9.11          The application for registration complete with Annexure shall be submitted in original in a sealed cover, super scribed:

9.12          The application for registration complete with annexure shall be submitted to the office from where the registration documents have been purchased. The attention of the contractor is specially drawn to the procedure inviting application for registrations for ‘A’,’B’ & ‘C’  Class by the Headquarters unit of the N.F.Railway(Construction). It may be noted that submission of the application for registration to the correct office in the correct form is the sole responsibility of the contractor. In the event of any application for registration being received by the unit not concerned with the registration applied for such wrongly addressed application may at the sole discretion of the N.F.Railway(Construction) be rejected and therefore, not considered for registration.

PART-II(b)

CONDITIONS FOR REGISTRATION

1.1       The procedure/objective of registration of approved lists, there likely use for inviting limited tenders have been described hereinbefore in this Registration Document. The Contractor applying for registration is deemed to have completely understood the procedures and the intent of the N.F.Railway (Construction) in this regard after seeking the necessary clarifications from the concerned office of the N.F.Railway(Construction) as provided hereinbefore in this Registration Document. The application for registration is, therefore, deemed to have been submitted after a complete understanding of the terms and conditions for registration of Civil Engineering Contractors on the N.F.Railway(Construction).

1.2       The enlistment of a Contractor in one or more Approved lists will be at the sole discretion of the N.F.Railway(Construction) and the applicant contractor is not entitled to question his or any other contractor’s inclusion/ exclusion from the Approved Lists under any work category of contractors, nor will the N.F.Railway(Construction) be required in any manner whatsoever to inform the applicant contractor the Railway’s reasons for inclusion/ exclusion of his or any other contractor’s name from any of the Approved Lists.

1.3       The N.F.Railway(Construction) is entitled at its sole discretion to modify (including enlargement/ cancellation of) the Approved Lists from time to time and the applicant contractor is not entitled to question his or any other contractor’s inclusion/ deletion in the Approved Lists under any work category of contractors, nor will the N.F.Railway(Construction) be required in any manner whatsoever to inform the applicant contractor the Railway’s reasons for the modifications of the Approved Lists.

1.4       The applicant contractor is deemed to have submitted complete and accurate information, required for considering his application for registration. The N.F.Railway (Construction) reserves the right to verify, in any manner at its sole discretion, the accuracy of the information furnished by the applicant contractor. It is understood and that applicant contractor agrees that any time before or after the approved lists are formed, if any of the information submitted with the application for registration is found to have been knowingly submitted in an incorrect manner (including suppression/ deleting of information relevant to the Registration process) apart from excluding/deleting) the defaulting applicant contractor’s name from the Approved Lists, the N.F.Railway(Construction) and other organizations under the Indian Railways will be entitled to suspend business with the defaulting applicant contractor without giving any show cause or any other notice in this behalf.

1.5       It is understood and agreed by the applicant Contractor that the Approved Lists including the process for their formation being only for the official use of the N.F.Railway (Construction) shall be considered as the confidential record of the N.F.Railwway (Construction) and the applicant contractor shall not have any request or access to these documents and the contents thereof.

1.6       It is understood and agreed by the applicant contractor that submission of the application for registration does not confer on his any right in regard to award of Contracts, except for being considered for enlistment in the Approved Lists and entitled to submit his bids as & when specifically called up on to do so.

PART-II(c)

INFORMATION ABOUT APPLICANT CONTRACTOR

1.1       The applicant should ensure that all the information are adequate to clearly establish his experience and current capacity for being enlisted for the different categories of works as sought for under the application is furnished in full detail. It may be noted that the concerned office of the N.F.Railway(Construction) do not have any obligation to seek clarifications on the information furnished with the application for registration. If the information furnished is incomplete or inadequate, the registration will be processed by the N.F.Railway (Construction) on the basis of the information available with the N.F.Railway and no please of the applicant contractor on this account will be entertained.

1.2       Submission of complete and accurate information is the responsibility of the contractor applying for registration. The N.F.Railway(Construction) reserves the right to verify, in any manner at its sole discretion, the accuracy of the information furnished by the applicant and also ask for the original documents for verification of the applicant contractor’s claims. If it is revealed whether before or after the forming of the Approved Lists, that an applicant contractor had knowingly submitted incorrect information (including suppression of information relevant to the registration process), apart from excluding/ deleting the defaulting applicant contractor’s name from the Approved Lists, the N.F.Railway(Construction) and the other organizations under the Indian Railways will be entitled to suspend business with the defaulting contractor without giving any show cause or any other notice in this behalf.

1.3       It would be advantageous if the statements made regarding the past experience, equipments, manpower resources, financial position etc. are supported by certificates/ testimonials given by the concerned agencies competent to issue such certificates/ testimonials.

1.4  Although the applicant contractor is free to adopt his own form for submitting the information, he may at his own option furnish the information in the forms (Annexure-‘A’ to Annexure-‘F’) enclosed with his part. The particulars furnished by the applicant contractor shall cover at least the elements of information identified in each of the above mentioned Annexure. It would also be useful if the information is submitted in the form of Annexure, each of the Annexure generally giving the information for the area generally classified in the forms of Annexure enclosed with the Registration Document.

It is also necessary that on each of such Annexure, a certificate is recorded by the applicant contractor to the effect that the information furnished in the concerned Annexure is true to the best of his knowledge. An index listing all the Annexure enclosed with the application for registration may be enclosed with this PART-II(c).

1.5        The contractor shall submit the application for enlistment in the forms of a bound booklet of A-4 size. The pages in the Application Booklet should be serially numbered and each page shall be signed by the Contractor along with the impression of the firm’s stamp.
